1. Agreement to terms
These Terms of Service (“Terms”) are a legal agreement between you and My Cuppa Coffee Pty Ltd (“MCC”, “we”, “us”, “our”) governing your use of the My Cuppa Coffee platform, including our website at mycuppacoffee.com.au and any associated mobile applications (the “Platform”).
By creating an account, taking our personality quiz, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
These Terms apply to consumers (“Cuppa Lovers”). If you are registering as a café business, the Café Owner Terms of Service apply to you instead.
2. Eligibility
You must be at least 16 years old to create an account. By registering, you represent that you are at least 16 and that all information you provide is accurate and complete.
If you are between 16 and 18, you represent that you have the consent of a parent or guardian to use the Platform.
3. Your account
3.1 Registration
You may create an account using your email address or through Google sign-in. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 Accuracy
You agree to provide accurate, current, and complete information during registration and to update it as necessary. We may suspend or terminate accounts with materially inaccurate information.
3.3 One account per person
Each person may maintain only one consumer account. Creating multiple accounts to abuse loyalty programmes, manipulate reviews, or circumvent restrictions is prohibited and may result in account termination.
4. The personality quiz
4.1 Purpose
Our coffee personality quiz asks you a series of questions about your preferences, habits, and values to determine your coffee personality type. Your personality type is used to calculate match scores with cafés on the Platform, providing personalised recommendations.
4.2 Nature of the quiz
The personality quiz is designed for entertainment and recommendation purposes. It is not a psychological assessment, clinical tool, or diagnostic instrument. Your results reflect preference patterns for the purpose of café matching and should not be interpreted as psychological or personality evaluations.
4.3 Automated processing
By taking the quiz, you consent to the automated processing of your responses to generate your personality type and café match scores. You may retake the quiz at any time to update your results. For more information about how quiz data is used, see our Privacy Policy.
4.4 Match scores
Match scores between you and cafés are algorithmic estimates based on your personality type and the café’s attributes. A high match score does not guarantee you will enjoy a café, and a low match score does not mean you will not. Match scores are one tool among many for discovering cafés.
5. The universal loyalty card
5.1 Your MCC card
When you create an account, you automatically receive a My Cuppa Coffee universal loyalty card (“MCC Card”). Your MCC Card works across all participating cafés on the Platform.
5.2 How it works
- Each participating café sets its own loyalty programme: the number of stamps required, the reward offered, and any conditions.
- You collect stamps by scanning a QR code at the café (or having the café scan yours).
- When you reach the required number of stamps at a specific café, you earn a reward as defined by that café.
- Stamp progress is tracked separately for each café’s programme.
5.3 Important limitations
- MCC provides the loyalty platform. We do not provide, guarantee, or fund the rewards. The café is solely responsible for honouring its stated rewards.
- Stamps and rewards have no cash value and cannot be transferred, sold, or exchanged.
- Cafés may modify or discontinue their loyalty programmes at any time. If a programme changes, your existing stamp progress will be honoured under the previous terms up to completion of the current reward cycle.
- MCC may impose reasonable limits on stamp collection (e.g. cooldown periods, daily caps) to prevent abuse.
- Stamps may not be collected through fraudulent means, including scanning without a genuine purchase.
5.4 Cross-café tracking
Your MCC Card tracks your stamp activity across all participating cafés. This means MCC maintains a record of which cafés you visit and when. See our Privacy Policy for how this data is used and protected.
6. Subscriptions
6.1 Free and Premium tiers
The Platform offers a free tier and a premium tier (“Cuppa Lover Premium”) at $10 per month.
Premium features include priority matching, advanced discovery filters, early access to new features, an ad-free experience, and exclusive promotions. The specific features available to each tier may change over time; current features are listed at /pricing.
6.2 Billing and renewal
Premium subscriptions are billed monthly through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will not be charged for the next period if you cancel before it begins.
6.3 Cancellation
You may cancel your Premium subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain Premium features until that date.
6.4 Refunds
Refunds are handled in accordance with Australian Consumer Law. If the Platform has a major failure (as defined by the ACL), you are entitled to a refund. For minor failures, we will remedy the issue within a reasonable time.

6.5 Price changes
We may change subscription pricing with at least 30 days’ notice. Price changes apply to the next billing period after notice is given. If you do not agree with a price change, you may cancel before the new price takes effect.
7. Reviews and user content
7.1 Your content
You may submit reviews, ratings, and other content (“User Content”) through the Platform. You retain ownership of your User Content.
7.2 Licence grant
By submitting User Content, you grant MCC a worldwide, non-exclusive, royalty-free, transferable licence to use, display, reproduce, distribute, and modify your User Content in connection with operating and promoting the Platform. This licence survives account deletion for User Content that has already been published (attributed to “Deleted User”), unless you request full deletion.
7.3 Content standards
Your User Content must not:
- Contain false or misleading claims
- Include personal attacks, threats, harassment, or hate speech
- Contain spam, advertising, or promotional material
- Infringe any third party’s intellectual property or privacy rights
- Violate any law
- Contain content that is obscene, defamatory, or discriminatory
7.4 Moderation
We reserve the right to review, edit, or remove any User Content that violates these Terms or that we reasonably consider harmful, misleading, or inappropriate. We are not obligated to monitor all User Content.
7.5 Café owner responses
Café owners on eligible subscription tiers may respond to your reviews. Responses are visible to all users.
8. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose
- Create false or misleading accounts or reviews
- Attempt to access another user’s account
- Collect stamps without making genuine purchases
- Reverse-engineer, decompile, or attempt to extract the source code of the Platform or its algorithms
- Scrape, crawl, or use automated means to access the Platform without our permission
- Interfere with or disrupt the Platform’s operation
- Use the Platform to send unsolicited communications
9. Intellectual property
9.1 Our intellectual property
The Platform, including its design, features, content, personality quiz system, matching algorithms, and all associated intellectual property, is owned by MCC or its licensors. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Platform as described here.
9.2 Feedback
If you provide suggestions, ideas, or feedback about the Platform, you grant us the right to use that feedback without restriction or compensation.
10. Disclaimers
10.1 Platform provided “as is”
To the maximum extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
10.2 No endorsement
MCC does not endorse any café listed on the Platform. Listings and match scores are informational. We do not guarantee the quality, safety, hygiene, accessibility, or suitability of any café. Your decision to visit a café is your own.
10.3 Accuracy
While we strive for accuracy, we do not warrant that café information (hours, menus, prices, amenities) is always current or correct. Café information is provided by café owners or sourced from third parties and may change without notice.
10.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies consumer guarantees or other rights you have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
11. Limitation of liability
To the maximum extent permitted by law:
- MCC’s total liability to you for all claims arising from or relating to these Terms or your use of the Platform is limited to the amount you have paid to MCC in the 12 months preceding the claim, or $100, whichever is greater.
- MCC is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.
These limitations do not apply to liability that cannot be excluded under Australian Consumer Law or to liability for fraud or wilful misconduct.
12. Indemnification
You agree to indemnify and hold MCC harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your breach of these Terms; (b) your User Content; (c) your use of the Platform in violation of any law; or (d) your fraudulent use of the loyalty system.
13. Account suspension and termination
13.1 By you
You may close your account at any time through your account settings or by contacting us. See our Privacy Policy for data retention after account closure.
13.2 By us
We may suspend or terminate your account if you: violate these Terms; engage in fraudulent activity; create multiple accounts; abuse the loyalty system; or engage in conduct that harms other users, café owners, or MCC.
Where practicable, we will provide notice and an opportunity to remedy the issue before termination. We may suspend immediately without notice where there is a risk of harm or fraud.
13.3 Effect of termination
On termination: your access to the Platform ceases; any unredeemed loyalty stamps or rewards are forfeited; your Premium subscription (if any) is cancelled. Content you have submitted (reviews) may be retained in anonymised form unless you request full deletion.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance.
If you do not agree with the updated Terms, you should stop using the Platform and close your account.
15. General
Governing law: These Terms are governed by the laws of Queensland, Australia.
Jurisdiction: Any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Queensland, Australia.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in effect.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MCC regarding your use of the Platform as a consumer.
Assignment: MCC may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your rights or obligations.
No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver.
