The rules that govern your use of My Cuppa Coffee as a café business.

1. Agreement to terms

These Café Owner Terms of Service (“Terms”) are a legal agreement between you (the “Café Owner”, “you”) and My Cuppa Coffee Pty Ltd (“MCC”, “we”, “us”, “our”) governing your use of the My Cuppa Coffee platform as a business (the “Platform”).

By registering a café on the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not register.

These Terms apply to café owners and business operators. If you are a consumer (“Cuppa Lover”), the Consumer Terms of Service apply instead.

You represent that you are authorised to enter into these Terms on behalf of the business you are registering.


2. Your café listing

2.1 Registration

To list your café, you must provide accurate business information including: business name, address, contact details, operating hours, and other information as prompted during setup.

2.2 Accuracy and updates

You are responsible for keeping your listing information accurate and current. This includes operating hours, contact details, menu information, amenities, and photos. Inaccurate listings may be flagged, suspended, or removed.

2.3 Listing content

All content you upload (photos, descriptions, menu items) must: be truthful and not misleading; not infringe third-party intellectual property; comply with all applicable laws including Australian Consumer Law; and be appropriate for a general audience.

2.4 Unclaimed listings

MCC may create basic listings for cafés using publicly available information (e.g. Google Maps data). If your café has an unclaimed listing, you may claim it by verifying your ownership. Unclaimed listings display limited information and do not have access to paid features.


3. Subscriptions and billing

3.1 Subscription tiers

The Platform offers the following subscription tiers: Free, Starter ($79/month), Growth ($149/month), Premium ($249/month), and Enterprise ($499+/month). Features available at each tier are described at /pricing and may be updated from time to time.

Each tier includes all features of the tiers below it.

3.2 Billing

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorise us to charge your designated payment method on a recurring monthly basis.

3.3 Automatic renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. We will send a reminder at least 7 days before renewal.

3.4 Upgrades and downgrades

You may upgrade your subscription at any time. Upgrades take effect immediately, and you will be charged the prorated difference. You may downgrade at the end of your current billing period. On downgrade, you will lose access to features above your new tier.

3.5 Cancellation

You may cancel your subscription at any time through your dashboard settings. Cancellation takes effect at the end of your current billing period. Your listing will revert to the Free tier.

3.6 Refunds

Refunds are handled in accordance with Australian Consumer Law. If the Platform experiences a major failure, you are entitled to a refund. We do not offer refunds for change of mind or underutilisation of features.

3.7 Price changes

We may change subscription pricing with at least 60 days’ notice to existing subscribers. Price changes apply to the billing period beginning after the notice period. You may cancel before the new price takes effect without penalty.


4. Founding Member Programme

4.1 Offer

The first 50 cafés to join the Platform may be eligible for the Founding Member programme: Growth tier features ($149/month value) at no cost for 3 months from activation.

4.2 After the promotional period

At the end of the 3-month promotional period, you may: choose a paid subscription tier (Starter, Growth, Premium, or Enterprise) at the standard rate; or revert to the Free tier.

If you take no action, your account will revert to the Free tier. You will not be charged automatically after the promotional period.

4.3 Conditions

Founding Member slots are limited and allocated at MCC’s discretion. MCC reserves the right to modify or discontinue the Founding Member programme at any time, provided that existing Founding Members will receive their full 3-month promotional period.

Founding Members receive a “Founding Member” badge on their listing for the life of their paid subscription.


5. Loyalty programmes

5.1 Setting up a programme

Café owners on Starter tier and above may create loyalty programmes through the Platform. You define: the number of stamps required for a reward, the reward offered, any conditions or restrictions, and programme duration.

5.2 Your obligations

If you create a loyalty programme, you are solely responsible for honouring rewards as described. MCC facilitates the stamp and reward tracking but does not fund, guarantee, or underwrite any reward.

You must: honour valid reward redemptions; not retroactively change programme terms to the detriment of customers who have already begun collecting stamps (changes apply to new collection cycles only); and ensure rewards comply with all applicable laws.

5.3 Programme changes

You may modify your loyalty programme at any time. Changes apply prospectively. Customers with existing stamp progress will be entitled to complete their current reward cycle under the original terms.

5.4 Programme termination

If you discontinue your loyalty programme, customers with existing stamp progress should be given a reasonable redemption window (minimum 30 days) to complete their current cycle or forfeit remaining stamps.


6. Customer data and analytics

6.1 What you receive

Depending on your subscription tier, you may access:

  • Discovery analytics (views, clicks, profile visits)
  • Loyalty analytics (stamps issued, rewards redeemed, active members)
  • Customer personality insights (aggregated personality type distribution of your matched and visiting customers)
  • Campaign performance metrics

All customer data provided to you through the Platform is aggregated and de-identified unless the customer has directly interacted with your café (e.g. by scanning a QR code, at which point you see their display name and stamp count for your programme only).

6.2 Restrictions on data use

You agree that customer data accessed through the Platform:

  • May only be used for the purpose of operating and improving your café business
  • May not be sold, rented, or shared with third parties
  • May not be used to build or contribute to a competing platform, matching system, or customer database
  • May not be used for marketing outside the Platform unless you have obtained separate, direct consent from the individual
  • Must be handled in accordance with the Australian Privacy Act 1988

6.3 Data on departure

If you cancel your subscription or leave the Platform, you may export your own business data (listing details, programme configuration, aggregate loyalty statistics) through available export tools. You may not retain individual customer data or personality insights after departure.


7. Reviews

7.1 Your rights

You may view all reviews of your café. On eligible subscription tiers, you may respond to reviews. Your responses are visible to all users.

7.2 Your obligations

You must not: offer payment, discounts, or incentives in exchange for reviews or the removal of reviews; create fake reviews of your own café or competitors; threaten, harass, or retaliate against reviewers; or report reviews as inappropriate solely because they are negative.

7.3 Inappropriate reviews

If you believe a review violates our Community Guidelines, you may report it for review by MCC. We will assess reported reviews against our guidelines and may remove reviews that violate them. Our decision on review moderation is final.


8. API and integrations

8.1 Availability

API access, webhooks, POS integrations, and white-label features are available on Premium and Enterprise tiers.

8.2 Acceptable use

You agree to use the API and integrations in accordance with our API documentation and any rate limits specified. You must not use the API to: scrape or bulk-download data; build a competing product; circumvent subscription tier limitations; or exceed reasonable usage volumes.

8.3 API key security

You are responsible for the security of your API keys. Do not share them publicly or embed them in client-side code. Report compromised keys immediately.


9. Verification

9.1 Business verification

MCC may require you to verify your identity and business ownership through our verification partner (Persona) or through other means. Verification may be required before you can access certain features or claim an existing listing.

9.2 Verification data

Identity documents submitted for verification are processed by our verification partner and are not stored by MCC after verification is complete. See our Privacy Policy for details.


10. Intellectual property

10.1 Your content

You retain ownership of the content you upload (photos, descriptions, menus). By uploading content, you grant MCC a worldwide, non-exclusive, royalty-free licence to use, display, and reproduce your content in connection with operating and promoting the Platform.

10.2 Our intellectual property

The Platform, its features, design, algorithms, and all associated intellectual property are owned by MCC. You may not reverse-engineer, decompile, or attempt to extract any part of the Platform’s technology, including matching algorithms, scoring systems, or recommendation logic.

10.3 MCC branding

We may provide you with MCC branding materials (e.g. QR code displays, “Find us on My Cuppa Coffee” stickers). You may use these materials solely for promoting your café’s presence on the Platform and in accordance with our brand guidelines.


11. Disclaimers and liability

11.1 Platform “as is”

The Platform is provided “as is”. While we strive for reliability, we do not guarantee uninterrupted access or error-free operation.

11.2 No guarantee of results

MCC does not guarantee any specific business outcomes, customer volumes, or revenue from using the Platform. Match scores, analytics, and recommendations are tools to assist your business, not guarantees of performance.

11.3 Limitation of liability

To the maximum extent permitted by law, MCC’s total liability to you for all claims arising from these Terms is limited to the total subscription fees you have paid to MCC in the 12 months preceding the claim.

MCC is not liable for: loss of revenue, customers, data, or goodwill; indirect or consequential losses; or any issues arising from your café’s operations (food safety, service quality, employment matters).

11.4 Australian Consumer Law

Nothing in these Terms excludes rights or guarantees that cannot be excluded under Australian Consumer Law.


12. Indemnification

You agree to indemnify and hold MCC harmless from claims, losses, damages, and expenses arising from: (a) your breach of these Terms; (b) your café’s operations; (c) your loyalty programme and rewards; (d) your use of customer data; (e) disputes between you and your customers; or (f) any violation of applicable law.


13. Suspension and termination

13.1 By you

You may close your café account at any time. We recommend providing at least 30 days’ notice to allow customers to redeem outstanding loyalty rewards.

13.2 By us

We may suspend or terminate your account for: material breach of these Terms; persistent inaccuracy of listing information; failure to honour loyalty programme rewards; fraudulent activity; or non-payment of subscription fees (after 14 days’ grace period and notice).

13.3 Effect of termination

On termination: your listing is removed from active discovery; your loyalty programmes are frozen (customers with existing progress receive a 30-day redemption window); reviews of your café remain on the Platform attributed to the café name; your subscription is cancelled; and your access to analytics and customer data ceases.


14. Changes to these Terms

We may update these Terms with at least 30 days’ notice for material changes. Notice will be provided by email and through the Platform dashboard. Your continued use after the effective date constitutes acceptance.


15. General

Governing law: Queensland, Australia. Jurisdiction: Courts of Queensland, Australia. Severability, entire agreement, assignment, and no waiver: As standard.
